Appeals Court Rejects Tom Brady Deflategate Case

Tom Brady

An Appeals Court in America has rejected the appeal of New England Patriots football star,  Tom Brady, who was handed a 4-game suspension over a scheme to deflate footballs to make them easier to catch and throw. It created an undue advantage in play on the grid iron. Brady sued and fawning judge, Richard M. Berman, inappropriately tossed out the suspension. An appeals court reinstated it. Brady appealed the decision regarding the reinstatement of the 4-game suspension, but the appeals court has rejected it this week. The final legal rung Brady can appeal this matter to is the U.S. Supreme Court

Brady signed legally binding contracts with the New England Patriots and by default the NFL. This meant he agreed to abide by league rules and procedures. This was an internal matter at the NFL. It did not belong in the court system. However, Brady brought it there. No one deprived Brady of his rights. The NFL has treated Brady and others in the league quite well. I can't imagine the NFL is happy at being sued by someone they went to great lengths to please.

The new NFL season begins on September 11th, 2016 and Brady's backup quarterback, Jimmy Garoppolo, is set to take his place during the 4-game suspension.

US appeals court refuses to reconsider QB Tom Brady's 'Deflategate' case

38 Mins Ago - A federal appeals court has rejected Tom Brady's attempt to get a new hearing on his "Deflategate" suspension. Brady was asking for the full 2nd U.S. Circuit Court of Appeals to hear the case. In April, a three-judge panel said that NFL commissioner Roger Goodell was within his powers when he suspended the star quarterback four games for his role in a scheme to doctor the footballs used in a Jan. 18, 2015, playoff game...

Select Mortgage Companies In America Such As First Guaranty Mortgage Corporation Are Asking Consumers Their Race In Loan Applications Then Using It To Discriminate In Denying Loans

The LinkedIn profile of First Guaranty Mortgage Corporation CEO, Andrew Peters. First Guaranty Mortgage is owned by Kenneth E. Clark.

First Guaranty Mortgage Corporation, a company based in Virginia, is engaging in discriminatory and financially abusive acts against minorities, the disabled and people living in America of foreign origin, who try to obtain a mortgage with their company to buy a home. It is an ongoing, illegal practice damaging innocent people. Companies that behave in this manner should be put out of business.

Recently, the city of Miami sued Wells Fargo bank for discriminating against minorities and people living in America of foreign extraction, who tried to apply for home loans. A suspect Miami judge threw out the City Of Miami's valid case. However, a three judge appeals court in Washington, D.C. reinstated the case. You know judicial corruption has gotten terrible in America when a judge can corruptly throw out a case brought by the government.

In the appeals case City Of Miami vs. Wells Fargo & Co., (No. 14-14544 and D.C. Docket No. 1:13-cv-24508-WPD) the City of Miami prevailed as a panel of three district judges in Washington affirmed their complaint and remanded it back to the district court via a ruling that stated:

"The City’s charges were further amplified by the statements of several confidential witnesses who claimed that the Bank deliberately targeted black and Latino borrowers for predatory loans. For example, one former loan officer attested that Wells Fargo management steered low- and middle-income borrowers away from less expensive Community Reinvestment Act loans and toward more expensive Fair Housing Act and Freddie Mac loans. Id. at 36. Another claimed that the Bank targeted minority churches and their congregations for subprime loans. Id. at 37. A third claimed that Hispanic borrowers’ applications for refinancing were disproportionately denied: ‘a Rodriguez in the last name was treated differently than a Smith,’ he stated."

Let that sink in. There are mortgage companies in America, such as First Guaranty Mortgage Corporation and banks like Wells Fargo, who are discriminating against consumers in America based on them having ethnic sounding names such as "Rodriguez" or "Latisha" or "Mohammed" (black, Hispanic, Arab), hitting them with bigger loan fees and bad financial instruments, in bids at financially exploiting and abusing minorities and immigrants. That's terrible.

You know, the last lending institution who was caught doing that, Washington Mutual, is no more. The Judiciary Report ran a series of articles on Washington Mutual's criminal practices against minorities and within a couple years the company spectacularly collapsed, the remains bought for pennies on the dollar by Chase Bank (Washington Mutual Collapses Seized By Government and Washington Mutual Is No More). First Guaranty Mortgage Corporation needs to heed the warning, as that is what they are firmly headed for regarding their unlawful behavior. Said discriminatory, financially abusive practices costing minorities and immigrants money, homes and loans needs to stop.

There will be more on First Guaranty Mortgage Corporation in an upcoming Judiciary Report exposé.

Appeals Court Overturns Tom Brady's NFL Football Suspension Being Lifted By Fawning Judge

Tom Brady

The NFL scored a victory against one of its top football players, New England Patriots quarterback Tom Brady, who has been convincingly accused of engaging inappropriate behavior that is tantamount to cheating on the grid iron. Brady was accused of having teammates and Patriots' staff deflate footballs, making them easier for him to handle, which gave him an undue advantage in play.

Tom Brady in court last year smiling after questionable judicial ruling

Brady was handed a four game suspension for this misconduct. Brady filed a lawsuit and a biased judge, Richard M. Berman ,questionably and mysteriously tossed the suspension. The NFL filed a case with the appeals court to have the improper judicial ruling overturned. Yesterday the appeals court sided with the NFL and reinstated Brady's suspension.

Tom Brady

This reallly was not a matter that should have been brought before the courts. Sports leagues around the world have internal systems athletes agree to abide by and process decisions through. For Brady to have taken it to a partial judge, who is a fan of the sports star was inappropriate and brought the judiciary into disrepute due to the corrupt, fawning decision that was issued.

Federal court has reinstated the NFL's four-game suspension of Tom Brady

11:54 a.m. EDT April 25, 2016 -Round 2 – unlike the first – goes to the NFL – and Tom Brady’s four-game suspension has been reinstated. A panel of three judges in the U.S. Court of Appeals for the 2nd Circuit has ruled in favor of the league in the ongoing Deflategate case against the Patriots quarterback and the NFL Players Association.

The court announced the decision on its website Monday to reverse the decision by a U.S. District Judge, and reinstate Brady’s four-game suspension. This comes as a drastic momentum swing in the case, after the players union secured a significant victory last September, when District Judge Richard M. Berman vacated Brady’s four-game suspension for his alleged role in intentionally deflating footballs prior to the 2015 AFC Championship Game against the Indianapolis Colts...

16-Year-Old Girl Sentenced To Life In Prison For Killing An Armed Man Who Hired Her For Sex (Video)

Teen Denied The Right To Self-Defense Legal Defense

Warning: video contains sexually explicit language and profanity.

Recently, I watched a riveting documentary on teenage girl Cyntoia Brown, who was arrested at age 16 for shooting a 43-year-old man, who had brought her to his house to have sex with the underage minor. By age 16, Brown had engaged in sexual intercourse with 36 men and women, only four of which she actually wanted to sleep with. Brown, a victim of sexual abuse and rape by a family member, then a pimp who repeatedly exploited her, was given up for adoption by her mother at age two. Her father was physically abusive as well.

Mixed race girl Brown was adopted by a loving mother, but it's amazing how DNA took over and she made the same regrettable choices her biological mother did, without even knowing the two took similar negative paths in life. Brown's grandmother had substance abuse issues. Brown's mother Gina began taking drugs and prostituting herself at age 16. Then Brown, who grew up away from her biological mother, did the same thing at age 16 as well, but ended up committing murder when an incident of prostitution grew out of her control.

The jury in Tennessee did not view Brown as blameless in the shooting and sentenced her to life in prison for the murder of a man, who was breaking the law in paying for sex with a minor. Now aged 18, Brown fights for her freedom from behind bars, as her public defender files appeals. She has expressed sincere regret over her life choices.

When a sin runs through a family, it tends to grow worse as it hits each generation, if something is not done to correct it. This is why it is important to talk to your kids and discourage them from making the same mistakes you did. Teach your kids that they don't have to make the same wrong choices and there is a better way. Break the cycle. Prayer is a very useful tool as well.

Some of you are on the cusp of making terrible life decisions that could land you behind bars. Don't do it. There are no shortcuts in life and revenge is not the answer to your problems. As difficult as it may seem at first, do things the right way and take the high road. Even if you've gotten in trouble, do your best to get back on your feet and start again. Don't give up on yourself or let others judge you for your past mistakes. Move forward along the right path.

David Beckham Loses Appeal In Prostitute Libel And Defamation Case

The Beckhams

This is a follow up to the February 15. 2011 article Judge Questionably Throws Out David Beckham Case. Beckham’s libel appeal against prostitute Irma Nici, over claims she had sex with him, breaking his marriage vow, was recently denied by the appeals circuit.

Irma Nici

It’s not surprising, as many cases regarding people like Murdoch (and separately in this case the publishers behind In Touch) are mysteriously dismissed, having been corrupted by him in illegal ways. Beckham was able to prove he was not at the hotel or the country at the time Nici claimed the two had sex. Hotel management also denied Nici was at the hotel on the day in question. The article also contained factual errors, regarding Beckham’s hairstyle at the time, as photographic evidence revealed his hair looked nothing like she described. There are too many holes in her story.

Irma Nici

A person should not be able to make such allegations in print regarding someone’s conduct without proof (travel documents, passport stamps, receipts - all of which the accuser lacks) and it prevail in a court of law. It undermines the court system. Free speech does not give one the right to defamation.

Conrad Murray Appeals His Manslaughter Conviction In The Death Of Singer Michael Jackson

Michael Jackson

Conrad Murray, the former doctor that tended to pop star Michael Jackson in the months before he died, overdosing him on the pharmaceutical drug, Propofol, has filed an appeal in his manslaughter conviction in connection with the singer's death in his Bel Air home at the age of 49.

Murray was overwhelmingly found guilty by a Los Angeles jury, who were in complete unison regarding his criminal misconduct. Judge Michael Pastor also threw the book at Murray, whilst issuing a stern lecture on the lethal consequences of his wanton decisions for money.

Conrad Murray

Murray remains in jail and is representing himself for the appeal. An ill-advised documentary Murray did into the death of Jackson featured him speaking ill of his attorney as "unprepared." Clearly, he feels he can do better. The Judiciary Report would be genuinely surprised if Murray will be successful in overturning the conviction, as the jury was so unanimous and there are no obvious discrepancies or blaring omissions in the prosecution's case.

However, having stated that, I don't have access to all the case documents from the trial, to poke any possible holes in it, but I did watch it online and the prosecution put on a good, solid case. It is going to be hard to deconstruct what the prosecution in this case did and somehow prove it was wrong. Murray's worst enemy right now is the evidence.

Buju Banton Convicted On Drug Charges After Mistrial

Buju Banton (left)

Dancehall singer, Buju Banton, real name, Mark Myrie, was convicted this week on drug charges in Tampa, Florida. He has been remanded into custody. The original case brought against him last year resulted in a mistrial.

However, the singer was found guilty this week, in spite of the fact, the government's cooperating witness in the case stated, the drugs, guns and vehicle used in the set up did not belong to Banton. His attorney announced they will lodge an appeal.

Obama To Appeal Ruling Against His Health Care Law

Barack Obama

U.S. President Barack Obama, is set to appeal the judicial ruling of Florida judge, Roger Vinson, who struck down his health care law. Judge Vinson ruled Obamacare is unconstitutional, much to the applause of the President's rival Republicans.

President Obama's Justice Department, headed up by inept Attorney General, Eric Holder, has taken umbrage with the ruling. A Justice Department representative stated they "strongly disagree" with Vinson and shall take the matter to the appeals court. If that measure fails, the Supreme Court will most likely take up the matter.

Obamacare is in need of massive work. It throws around money like it is in abundance, at a time the nation is bankrupt. The bill was not structure in the most prudent, cost effective manner and shall wreak horrible havoc on the national deficit. Sadly, some in government like to find things out the hard way.

Rahm-ed Back On The Ballot

Rahm Emanuel, the former Chief-of-Staff, of beleaguered U.S. President, Barack Obama, has been rammed back onto the Chicago mayoral ballot, after being booted by an appeals court for failing to meet the 1-year residency requirement. The Illinois Supreme Court has decided he is eligible, even though he did not meet the requirement. Yea, I don't get it either.

Obama Betrays The Gays

Barack Obama

In spite of the fact, U.S. President, Barack Obama, often panders to the gay community, leading them to believe he will make same sex marriage national law, he has made a very decisive and detrimental move against them in court. The Obama Administration, has appealed a decision made by District Judge Joseph Tauro in Boston, which allowed same sex marriage in the U.S. state of Massachusetts.

For the record, the Judiciary Report is only in favor of heterosexual marriage, between a man and a woman, but wishes the gay community no harm. The site is commenting on this particular legal maneuver by the Obama Administration, due to its blatant hypocrisy, as he has repeatedly promised the gay community he will push their causes.

The President should not make promises he does not intend to keep, as that makes him like every other dishonest politician, pandering to the public for votes, with no desire to make good on all that has been said.

Obama To Appeal Stem Cell Ban

U.S. President Obama, pictured with his family, claims to be a family man, but sees no qualms about the abominably sanctioning the destruction of millions of embryos God created.

U.S. President Barack Obama, has instructed his Justice Department, headed up by the incompetent, Eric Holder, to appeal a wise judicial ruling, barring stem cell research in America, which is experimentation on human embryos.

It is quite appalling to think of the number of embryos that have been the subject of horrific experiments since Obama's 2009 decision, permitted such research. It shows a gross lack of respect for human life.

Jamaica Seeks To Bring Back The Death Penalty

An article in the Jamaica Observer, revealed some Jamaicans are in favor of bringing back the death penalty. Someone close to me, who has worked in the Jamaican judicial system for many years, is in favor of it, as some do not wish for their hard earned tax dollars to go towards housing, feeding and clothing serious criminals, who have damaged society in irreparable ways.

However, as a Jamaican, I don't think re-instituting the death penalty is a good idea. In general, countries need to move away from capital punishment. Undoubtedly, some people's deeds warrant it, for engaging in conduct that can only be labeled human atrocities, but the Judiciary Report is of the belief, life in prison is best for such egregious cases.

Jamaica needs to move towards the construction of an austere, maximum security prison, with hard labor for its occupants, to incarcerate those that have harmed society in a terrible manner and to act as a deterrent for those thinking of committing heinous crimes that would draw a life sentence.

In closing, respectfully, the Jamaican government needs to detach from the British Privy Council, as the aforementioned individual has proclaimed to me for years. Not for anything negative on the Council's part, but the fact criminals are abusing it to stretch out appeals, sending it to Britain and remaining free in Jamaica for years, wreaking havoc, when they belong behind bars. Keep the process a domestic one.
