New York Appeals Court Slams NSA Spying In Ruling Labeling It Illegal

New York's Second U.S. Circuit Court of Appeals has ruled against the National Security Agency's blanket spying on Americans, stating the Patriot Act did not allow the agency to engage in said misconduct. Former National Security Agency contractor, Edward Snowden, bravely exposed the agency's lawbreaking in indiscriminately spying on Americans.

NSA's phone spying program ruled illegal by appeals court

A U.S. spying program that systematically collects millions of Americans' phone records is illegal, a federal appeals court ruled on Thursday, putting pressure on Congress to quickly decide whether to replace or end the controversial anti-terrorism surveillance. Ruling on a program revealed by former government security contractor Edward Snowden, the 2nd U.S. Circuit Court of Appeals in Manhattan said the Patriot Act did not authorize the National Security Agency to collect Americans' calling records in bulk.

Circuit Judge Gerard Lynch wrote for a three-judge panel that Section 215, which addresses the FBI's ability to gather business records, could not be interpreted to have permitted the NSA to collect a "staggering" amount of phone records, contrary to claims by the Bush and Obama administrations.

"Such expansive development of government repositories of formerly private records would be an unprecedented contraction of the privacy expectations of all Americans," Lynch wrote in a 97-page decision. "We would expect such a momentous decision to be preceded by substantial debate, and expressed in unmistakable language. There is no evidence of such a debate."

The appeals court did not rule on whether the surveillance violated the U.S. Constitution. It also declined to halt the program, noting that parts of the Patriot Act including Section 215 expire on June 1. Lynch said it was "prudent" to give Congress a chance to decide what surveillance is permissible, given the national security interests at stake.

The Political Tool Of Choice For A Police State

U.S. President Barack Obama and Congress, have renewed the very unpopular, Patriot Act, extending it for another four years. The Patriot Act grants the FBI and other agencies, the legal right to invasively spy on you in your home, at work and in public.

The FBI, under Robert S. Mueller, repeatedly violated the alleged safeguards written into the Patriot Act legislation and each time they went back to the President and Congress, demanding even more power to pry into Americans' lives.

The FBI has used roving bugs (to listen into people's conversations, via switching on the mic in their mobile phones, anywhere and anytime they feel like). The FBI has also remotely and secretly accessed people's computers and turned on the webcams to spy on them in their homes.

The Patriot Act extends to wiretapping your home and mobile phone, reading your emails, accessing your computers via a software trojan and manufacturer backdoors (CIPAV), scanning your bank accounts, anonymously pulling your credit report, GPS tracking, physical surveillance stalking, if you are targeted by the White House, a member(s) of Congress or the FBI.

However, the Patriot Act has been abused by the government for political control, using the FBI to spy on domestic political rivals, scientists, doctors, journalists and bloggers, in gaining an undue advantage in elections. It has also been used for economic theft, in criminal violation of domestic and international law, to benefit large corporations. The "war on terror" is being used as a "war on privacy" regarding innocent Americans. More often than not, the Patriot Act has been used to spy on innocent people, than actual lawbreakers.

It was nothing but a con to turn America into a police state, where Washington would have complete control and autonomous power, which is unconstitutional. It's a government "for the people by the people" not to spy on the people.

FBI Agent Tried To Run Over Two Journalists With Car

Once again, another FBI agent has caused innocent people injury on the road. As previously mentioned on this site, three black youths have been killed in two unrelated incidents, where drunk FBI agents got behind the wheel, slammed into them, then lied about their actions.

A new case has surfaced, regarding a lawsuit by two journalists, Thomas Bagnall and William Greenback, who were DELIBERATELY run over by FBI agent, Joy Ellen Mullinax. The two journalists were removing equipment from their vehicle, parked in front of the National Press Club in Washington, DC, when FBI Agent Mullinax became impatient and decided to run them over to clear the way. That is psychotic.

I don't care what anyone says, there is something wrong with the FBI. There agents are full of anger, hostility and rage, due to their terrible Quantico training that has left them vicious robots waiting to snap with little or no provocation. The fact of the matter is too many FBI agents have committed brutal and violent acts of murder, vehicular manslaughter, domestic violence and battery against the public, including children. Hundreds of FBI employees have had run-ins with the law.

Cases have surfaced of pedophiles and sexual predators at the FBI. Just this week a new scandal erupted regarding FBI agents deliberately watching and surveilling young kids who committed no crime, in conduct that willfully violated the Constitution, US Code and Patriot Act. The agency is crazy, out of control and capable of anything. When they snap, they really snap.

The FBI Being Nosy In People's Personal Business

There are numerous cases online that contain inexcusable incidents of the FBI getting involved in people's personal lives to the point it crosses into perverse territory. The public also learned the FBI actively interferes in the personal lives of its employees, which is also appalling.

But this is nothing new. The FBI so targeted the late Dr. Martin Luther King Jr., they would send his wife letters and envelopes in the mail, alleging marital infidelity, in a move so common and crass, one has to wander if the agency has been stocked with complete perverts. This misconduct continues today and it is completely vile.

Bribe taking, FBI Director Robert S. Mueller, would not like it if someone sent his wife items in the mail or passed information along to her, while she got her hair done at the salon, outing his vast martial infidelity with two, young, nubile women he had no business having sex with, as it broke his marriage vows. As a general rule, you shouldn't get into innocent people's personal business, if you don't want them getting into yours and broadcasting it to the watching world. You run the risk of offending the wrong person that will publicly slam you for violating the Fourth Amendment. Hey, you've got your sources Robert "Jesse James" Mueller and so do I.

The Federal Bureau of Investigation are a bunch of hypocrites as well, as a long time FBI agent kidnapped his mistress, who stated she was leaving him after they had an affair, with him cheating on his wife of many years. Out of revenge, he held his mistress hostage in her own condominium, dragged her by her hair, tied her up, put his loaded gun in her mouth, then duck taped her mouth, beat her and threw her in a closet for hours. Yet they have the gall to accuse other people of misconduct, getting into the personal lives of others.

Today, everyone from victims of crimes to suspected criminals, who later turned out to be innocent, felt the unjust brunt of the FBI's privacy intrusion into who they date and socialize with and worst of all, trying to turn married couples against each other, who have wrongfully been labeled suspects in crimes they did not commit. How ugly and unbecoming.

The FBI is careless, reckless, negligent and openly violating U.S. law at innocent people's expense. They believe they are a law unto themselves and can do whatever they please, even if it flagrantly breaks the law.

The FBI harassed and terrorized scientist Steven Hatfill, accusing him of terrible crimes he did not commit. They got the accomplished scientist fired from his job, after the man spent years gaining university degrees at great financial expense, told his friends not to speak to him anymore, to psychologically isolate him, engaged local police to constantly give him fraudulent traffic tickets when he left the house, followed him everywhere and harassed him in public. They even tried to destroy his family. He sued and they later admitted he did not commit the crimes they accused him of to the nation and was forced to pay him $16 million dollars in damages. The FBI is an absolute disgrace to America. The FBI is managed by a bunch of crazy people with badges that just don't know when to stop. There are lab rats with more restraint and common sense than the FBI's management.

The FBI then turned its attention to scientist, Bruce Ivins. They harassed the wrongfully accused scientist to death - literally, as he ended up committing suicide, after having a nervous breakdown at the abuse the FBI relentlessly pummeled him with, just as they had done to Hatfill. They are reckless, arrogant, simply do not care and have absolutely no respect for human life. Respected scientists all over the world have since stated Ivins could not have committed the crimes the FBI accused him of, based on the scientific evidence the agency presented and the improbable time line that defies the laws of physics.

In Denver, Colorado, political activists, Food Not Bombs and The Watchdog Group, among others, have stated specific FBI agents have engaged in a massive harassment campaigns against them, in violation of domestic and international law, with illegal acts of harassment against them including, but not limited to, attempted murder.

Charitable groups that aimed to help people the FBI wrongly accused of crimes, reported their workers were subjected to harassment and intimidation by FBI agents, who showed up to said volunteers respective places of employment, attempting to get them fired from their jobs, not related to their charity work. That is something Hitler and the SS would do. That's how far the FBI has fallen.

It's amazing that U.S. law states the accused must receive legal representation and assistance, but out of fear of a fair fight, the FBI acts in illegal ways to diminish the chances of defendants, a number of whom are wrongly accused, of having a fair trial. If you are going to cheat to win, you are just as bad as the criminals.

Another charity group, run by American born citizens, that sought to help children in Iraq, were subjected to harassment by the FBI, with agents digging into their private lives, demanding to know who they date and socialize with, even calling them in for interviews at FBI field offices.

In closing, what business does a law enforcement agency have getting into the amorous, platonic and business relationships of citizens, like nasty voyeurs with nothing better to do, when there are terrorists actively seeking to harm America. What kind of losers do something like that.

Robert S. Mueller is a major apart of the reason U.S. tourism has logged massive, well documented declines over the past few years. With the FBI Director wiretapping, eavesdropping, hacking, harassing, trailing and illegally prying to the lives of many American citizens and residents, conduct for which he is repeatedly slammed in Congress to no avail, many tourists have been terrified of visiting America for fear their privacy will be invaded by the FBI, run by that mad dog the White House has refused to put on a leash.

Obama Renews Patriot Act Provisions

U.S. President Barack Obama, has renewed former President George W. Bush's controversial Patriot Act, in particular, three provisions, some of which are sorely being abused by the FBI.

The provision that, "Authorizes court-approved roving wiretaps that permit surveillance on multiple phones" is severely being abused by the FBI, to spy on innocent people in America, both citizen and non-citizen, with no suspected terrorist affiliations.

There is a type of roving mobile phone bug (wiretap) the Judiciary Report wrote about two years ago, based on a story that ran on Fox News. The FBI has the ability to turn on your mobile phone anywhere you are, triggering the microphone and having it act as an audio bug.

This enables them to pick up all conversation wherever the mobile phone is present, whether it be in your living room, bedroom, home office, car, church or at work.

It was used in a mafia case a few years ago and as you can tell, a Mafioso is not typically classified as a terrorist, but rather a hardened criminal.

However, on the orders of FBI Director, Robert S. Mueller, roving mobile phone audio bugs mentioned above, have also been improperly and illegally used on journalists, bloggers, politicians, community workers, activists and businesspeople, among others, who have not broken the law.

In some instances, it was done off the record, in others the FBI flat out lied, making up stories, trying to tie innocent people to terrorist investigations they knew they had nothing to do with, in order to spy on people they had no legal grounds to place under invasive surveillance.

Then, when they've sufficiently snooped on the innocent targets, they close out the sub-investigations, claiming there was no finding of terrorism or connection thereto, regarding said journalist, blogger, activist ect...

It's fine to employing surveillance methods on genuine terrorist suspects, but some people in America have been subjected to this, based on political and financial reasons, which is unconstitutional and unlawful.

Saturday, February 27, 2010; 6:11 PM - WASHINGTON -- President Barack Obama has signed a one-year extension of several provisions in the nation's main counterterrorism law, the Patriot Act.

Provisions in the measure would have expired on Sunday without Obama's signature Saturday.

The act, which was adopted in the weeks after the Sept. 11, 2001 terror attacks, expands the government's ability to monitor Americans in the name of national security.

Three sections of the Patriot Act that stay in force will:

-Authorize court-approved roving wiretaps that permit surveillance on multiple phones.

-Allow court-approved seizure of records and property in anti-terrorism operations.

-Permit surveillance against a so-called lone wolf, a non-U.S. citizen engaged in terrorism who may not be part of a recognized terrorist group...

FBI Collected Thousands Of Phone Records Illegally

Never let it be said the FBI let a little thing like the law get in their way of violating scores of people's rights. Based on reports today, the FBI collected thousands of people's phone records by flat out lying about exigent circumstances that never existed, to use the dubious national security letters to spy on Americans. FBI Director Robert S. Mueller claims he knew nothing of what many FBI agents did in this regard. However, Mueller knew. He orchestrated it. He is a disgraceful liar.

When I broke the story in December 2006, which was confirmed by the Inspector General's report in March 2007, based on what was relayed to me by a very credible source in 2006, I was informed FBI Director Robert S. Mueller was illegally spying on select people and passing the contents around among his cronies and other officials in government.

Targets selected for surveillance, such as specific scientists, political scientists, inventors, journalists, political bloggers, activists and politicians to name a few, had their privacy thoroughly violated by Mueller and FBI HQ, via the FBI employees he instructed to do so.

Granted, some FBI agents of their own accord, abused this privilege to pry into the lives of wives and girlfriends, even women they wanted to pursue sexually. However, the illegal activity was largely directed by Mueller and HQ and consigned to select surveillance targets, who hadn't done anything wrong. It has been a vile invasion of privacy, which is something sacred.

Said surveillance included wiretap transcripts (phone and cell phone), emails, text messages, internet searches, computer documents (FBI's CIPAV trojan), GPS, roving bugs, credit card purchases (itemized), travel records, library records, credit reports, banking activity and medical records, illegally accessed and copied, then all bundled up and sent to Mueller and others at FBI hq upon request.

Mueller is also a nasty old pervert, who is power mad. When he was not misusing this vital congressional tool in spying on the aforementioned, who did nothing wrong, he was prying into the lives of younger women.

When the agency gets into trouble for certain misdeeds, Mueller tries to dupe the FBI agents into destroying incriminating files, which is very illegal, by telling them they are "doing it for your country" under the guise of "American Pride." It's the same reason the FBI keeps hiding the real Martin Luther King Jr. files - they don't want the public to know the terrible things the FBI has done.

Mueller is a criminal. Full stop. He deserves to be called out for what he truly is and what he is doing to this nation and other people in the world he has spied on as well, in egregious acts, with no mandate under federal law to do so. Someone should violate you and your family like that and see how you like it, you dirty old man.

Report: FBI Illegally Collected Phone Records

Published: January 19, 2010 - WASHINGTON (AP) -- The FBI violated the law in collecting thousands of U.S. telephone records during the Bush administration, The Washington Post reported Monday.

Citing internal memos and interviews, the Post said the FBI invoked nonexistent terrorism emergencies or persuaded phone companies to provide information as it illegally gathered more than 2,000 records between 2002 and 2006.

The bureau said in 2007 that it had improperly obtained some phone records, and the Justice Department inspector general is expected to release a report this month detailing the extent of the problem...

Documents obtained by the Post show that FBI managers as high as the assistant director level approved the emergency requests. Caproni said FBI Director Robert Mueller did not know about the requests until late 2006 or early 2007, after the inspector general's investigation had begun...

An FBI linguist, Shamai Kedem Leibowitz, who is also the grandson of a famous scholar, has pled guilty to leaking 5 classified documents to a Washington Post blogger, regarding the NSA illegally spying on Americans. He began his employment with the FBI at the beginning of the year.

It is wrong and unlawful for a U.S. government worker to leak classified documents to civilians, but the NSA was wrong in this case as well, for illegally spying on Americans, via misconduct expressly forbidden by the U.S. Constitution. It's the same unlawful invasiveness the FBI has engaged in as well.

I am of the belief, when rogue federal employees, such as the current FBI director, Robert S. Mueller, engage in criminal misdeeds, such as warantless wiretapping and illegally, electronically combing people's emails and then reading them, conduct that violates the Constitution and other legislative measures under the U.S. Code, they should face imprisonment.

Mueller is like a nosy, gossiping old housewife, running his trap to other members of the federal government and politicians, about matters that have nothing to do with national security, whilst forwarding email documents and phone call transcripts he illegally obtained, via unlawfully spying on Americans that committed no crime.

He will order a person be put under surveillance (wiretaps, email scanning, bank account scanning ect) without just cause, if they are a (law abiding) journalist or blogger with widely read columns or blogs influencing public opinion, an inventive scientist or doctor doing groundbreaking work or a political scientist with new ideas.

He leaks said wiretap transcripts, emails and other invasive information on you, to politicians and other government members that are his cronies. He's worst than Hoover and not above stealing data either. The Constitution doesn't make allowances for such conduct, as it is contemptible. Who do you really think you are to be breaking the law like this. People are entitled to privacy.

"Immunity shields” do not extend to government employees that criminally violate the law of the land. Some crooked federal employees, such as Robert S. Mueller, cite such criminal conduct as behavior they are allowed to engage in at their discretion, in their official capacity, which is a load of garbage not supported by any law, domestic or international.

There is no discretionary factor that allows such misconduct, as it would open the door for FBI, DOJ, NSA and CIA employees, to decide in their judgment, certain unlawful conduct allegedly undertaken in the course of their jobs is okay, when it is not – such as rape, molestation, pedophilia, murder, manslaughter, lynching, assault, voyeurism and slavery, whilst causing grievous harm to innocent members of society. When did the law ever work that way.

FBI Linguist Guilty of Leaking Classified Documents to Blog

* December 18, 2009 - An Israeli-American lawyer who worked as an FBI linguist pleaded guilty Thursday to providing an unidentified blogger with classified documents derived from U.S. communications intelligence.

Shamai Kedem Leibowitz, 39, of Silver Spring, Maryland, pleaded to one felony count of disclosing to an unauthorized party five documents that were classified “secret” that he obtained through his work with the FBI.

Leibowitz leaked the documents to the unnamed blogger in April 2009. The blogger — identified as “Recipient A in court filings — then wrote a post based on the classified documents.

“As a trusted member of the FBI ranks, Leibowitz abused the trust of the FBI and the American public by using his access to classified information for his own purposes,” said FBI Special Agent in Charge Richard A. McFeely in a press release.

The government does not allege that Leibowitz was paid for the documents. He pleaded guilty to violating a law prohibiting the unauthorized disclosure of classified information about “communication intelligence activities” — i.e., electronic spying.

Leibowitz, who holds dual citizenship, was only employed as a contract Hebrew linguist for the FBI for about three months before he leaked the documents. He worked in an FBI office in Calverton, Maryland, beginning in January 2009 and held a top secret security clearance. As such, he had access to classified documents and information relating to the communication intelligence activities of the U.S., according to the Justice Department press release...

There was massive shock today at the city of Chicago, Illinois, being eliminated and in the first round, as a choice to host the 2016 Olympics, with Rio, Brazil winning the bid.

Many mainstream newspapers are attributing it to anti-American sentiment in the world, which is an accurate assumption.

Chicago is a great city, full of great people, with lots of wonderful architecture and much to see and do, but the damage the Bush administration has wrought in the world, is still fresh in many people’s minds.

The wars raging in the Middle East, Guantanamo prison abuses, Patriot Act abuses that have foreigners concerned about coming to the States, believing they can be summarily investigated and spied on with their privacy invaded, wiretapped, bugged and followed, coupled with other scandals such as the global economic downturn that began in Corporate America (with offshoots such as Bernard Madoff and R. Allen Stanford) the Erin Andrews hotel hidden camera case and others of the same nature, to do with invasion of privacy, such as the ongoing Hollywood wiretap scandals (Pellicano and others) has left the world dismayed and very concerned. People are literally scared to come to America.

The conduct Bush engaged in and the precedents he set, is not the America the world grew to know and love and it is scaring people all over the world.

The Judiciary Report believes it is not an international rejection of the American people, but of the U.S. government.

Many governments and entities in the world, cannot stomach what the U.S. government has done abroad and at home, committing and permitting acts that broke domestic and international law. Then again, everyday Americans can’t stomach what the government has done either.

Privacy Invading Patriot Act Up For Renewal

The thoroughly treacherous Robert S. Mueller, Director of the FBI

Former President George W. Bush's controversial Patriot Act is up for renewal and the Judiciary Report is against it. Not only is the Patriot Act being severely abused for political and governmental gain, it undermines the U.S. Constitution.

The FBI is using the provision to mine the phone calls, emails, mail and other communications of innocent people, searching for tips in cases and to create a political advantage in others instances.

The FBI is also illegally using it to commit corporate theft on behalf of certain conglomerates, which is a really dirty, dishonorable thing to do.

However, this is Robert S. Mueller's idea of innovation - blatant, outright grand theft larceny, conspiracy and fraud - as a means to unlawfully help specific corporations, executives and the famous - spitting on every standard of decency America (government) ever stated it stood for in the world.

He should be very ashamed of that, as it is disgracing him in the world. This madness helped to destroy the U.S. economy before and it is going to do it again.

Congress needs to rein in that loose cannon or face forthcoming international embarrassment that shall never be forgotten.

Side Bar: I hope Mueller knows his name is gone in the nation and the world, as government reps in several countries are taking extra precautions when it comes to dealing with him, due to the treachery he has displayed, which was too much for many to stomach.

Battle looms on renewing provisions of Patriot Act

Group of Democrats wants to rein in powers of surveillance with new privacy safeguards.

Posted: Sunday, Sep. 20, 2009 - WASHINGTON As Congress prepares to consider extending crucial provisions of the USA Patriot Act, civil liberties groups and some Democratic lawmakers are gearing up to press for sweeping changes to surveillance laws...

"We also are aware that members of Congress may propose modifications to provide additional protection for the privacy of law abiding Americans," Weich wrote, adding that "the administration is willing to consider such ideas, provided that they do not undermine the effectiveness of these important authorities."

The first such provision allows investigators to get "roving wiretap" court orders authorizing them to follow a target who switches phone numbers or phone companies, rather than having to apply for a new warrant each time.

From 2004 to 2009, the FBI applied for such an order about 140 times, Robert Mueller, the FBI director, said at a Senate Judiciary Committee hearing last week...

From 2004 to 2009, the bureau used that authority more than 250 times, Mueller said.

The final provision set to expire is called the "lone wolf" provision. It allows the FBI to get a court order to wiretap a terrorism suspect who is not connected to any foreign terrorist group or foreign government...
