Tampa Bay Buccaneers quarterback, Jameis Winston, has countersued rape accuser, Erica Kinsman, for defamation. Winston is seeking $70,000 in damages. Kinsman accused Winston of raping her while they were students at Florida State University, when people who witnessed their encounter said it was consensual. Kinsman was Winston's side chick who became angry when he refused to dump his girlfriend. Even after alleging rape, Kinsman kept going to Winston's football games and cheering for him, as revealed by tweets on social networking site Twitter. Kinsman has since deleted the tweets, but they were recovered by Winston's lawyers.

Police and prosecutors in Florida found Kinsman's rape claims to be untrue and full of discrepancies. Winston’s attorney also revealed Kinsman and her money hungry attorney/aunt, Patricia Caroll, who is fuelling these cases, tried to extort Winston, a top prospect for a lucrative multi-million dollar career in the NFL, demanding $7,000,000 to keep quiet about their rape allegations or they would go to the police .When Winston refused to pay, Kinsman and her aunt went to police, but the case fell to pieces as with contained lies.

Erica Kinsman, the woman accusing Florida State University football star Jameis Winston of rape, has filed a federal lawsuit against the school upon hearing the announcement he is going to the NFL (National Football League). The lawsuit should be dismissed. How is FSU responsible for what Kinsman claims Winston did, which has already been proven to be a lie. 

Suing a school for a "hostile educational environment" is ludicrous. What about the hostile environments Kinsman has created for Winston in being falsely accused of rape, with rival football players mocking him and people online insulting and threatening him. Kinsman and her lawyer aunt, Patricia Caroll, are suing FSU in a cash grab, as the school has money, where Winston does not at the present time.

Recently, retired Florida Supreme Court judge, Major Harding, did a review of the case and found no evidence of rape (Florida State University Football Player Jameis Winston Cleared Of Rape). Winston was cleared. This conduct left people with the impression no crime had occurred and it was actually an extortion bid.

The mere fact Kinsman and her aunt did not go to the police first and opted to demand money, should be a clear indication to many that the rape accusation is false. The fact people in Winston's apartment submitted written affidavits stating they saw her voluntarily go into Winston's bedroom with him, with one of the football player's friends walking in on her performing oral sex on him, leading to Kinsman laughing and telling him to close the door, does not speak well regarding her credibility or claims. Rape victims do not behave in that manner.

When Kinsman and her aunt finally went to the authorities after their failed extortion bid, they sent police in circles, withholding pertinent information and not returning calls for follow up interviews, which makes their claims of rape appear event more dubious. Why go to the police after a failed extortion bid, then withhold information from authorities impeding their investigation.

The fact subsequent tests revealed the presence of two men's sperm inside Kinsman - Winston and that of another man-  the identity of which she deliberately tried to hide from police, costing taxpayers money in tracking him down, created even more credibility issues. This is not the profile of rape. It is the profile of a financial scam gone awry.

Florida State University’s president, John Thrasher, stated, "After a year of selective news leaks and distorted coverage, Florida State looks forward to addressing these meritless allegations in court. Evidence will show that through its confidential victim advocate program, F.S.U. did everything the plaintiff asked for, and that the assertions F.S.U. shirked its Title IX obligations are false. F.S.U.’s handling of this matter was driven by the plaintiff’s deliberate and informed choice on how to proceed, not by athletics.”

Many sports professionals consider Winston to be the top university football player in America. He is expected to make millions of dollars in the NFL draft via a lucrative deal. Kinsman and her aunt already have their eyes on money Winston has not even earned yet, waiting to file a civil suit the moment he signs his first multimillion dollar deal. Once again, it should be evident, this case is about money and not rape. The sad part is Winston's life has been greatly damaged by it. Some believe he raped her, but the evidence says otherwise.

In closing, men need to be careful regarding picking up women they do not or barely know and having sex with them. While some women have been raped, there are numerous cases around the world of women crying rape out of revenge for a one night stand they thought was something more or for financial gain.

JAN. 7, 2015 - Jameis Winston was projected to be either the first or second player chosen in the upcoming draft. Quarterback Jameis Winston on Wednesday announced that he would make himself available for the N.F.L. draft, the same day that Florida State was sued by the woman who accused him of rape. 

The lawsuit, filed in United States District Court in Orlando, Fla., seeks a jury trial and damages while alleging that the woman’s Title IX rights were violated, a lawyer for the woman said. Florida State University Football Player Jameis Winston Cleared Of Rape

Former Florida Supreme Court justice, Major Harding, found Florida State University football player, James Winston, not guilty of committing rape or violating school rules. Erica Kinsman, who tried to extort $7,000,000 from the college football star, accused Winston of rape, but due to the many holes in her story, not only did prosecutors declined to charge Winston in a criminal court of law, now Harding has cleared him in a school inquiry as well.

Witnesses saw Kinsman, willingly enter Winston's bedroom with him, with one even catching her willingly performing oral sex on him. When they were interrupted, she laughed and ordered Winston's friend to leave and close the bedroom door. It was known on campus that she was cheating with Winston, who has a girlfriend, while Kinsman had a boyfriend as well.

Kinsman and her aunt, lawyer, Patricia Caroll, have sought to make millions off Winston, from what he and others present in his apartment that night, stated was consensual sex between two adults. These misdeeds have damaged Winston's name and career, in acts that are unfair and unacceptable. Worst of all, Kinsman's actions makes it difficult for real rape victims to be believed. There should be legal penalties, including jail time, for lying about being raped.

Erica Kinsman, the university student who accused Florida State University quarterback, Jameis Winston, of rape, but the case collapsed when doctors found semen from two men in her shorts, attempted to extort $7,000,000 from the athlete in exchange for her silence, prior to going to the police.

Today, Winston's attorney David Cornwell, released a letter to the press regarding the matter. Kinsman's lawyer, who is also her aunt, Patricia Carroll, is said to have stated, “To settle her client’s claims against FSU and Winston" the young athlete would have to promise to give them $7,000,000 when he turns pro and "you will never hear from my client or me again — in the press or anywhere." Their offer was declined by Winston and his attorney. A credible and true rape case would not be bought out in exchange for silence.

Winston and his friends insist the athlete's encounter with Kinsman was consensual. In fact, the police investigation revealed Winston's friends were present in the living room of his apartment, while Kinsman had sex with Winston in his bedroom. His friends state Kinsman willingly had sex with Winston. Kinsman claimed she was drunk but toxicology tests revealed she was not. These facts coupled with the fact doctors found the sperm of two men in her underwear, one belonging to Jameis Winston and the other she refused to identify to police, destroyed her credibility.

The Lawyer Representing Jameis Winston's Accuser Tries To Cast Negative Shadow Over Heisman Ceremony

Attorney Patricia Caroll, the aunt of Jameis Winston's accuser, Erica Kinsman, resurfaced yesterday via a publicity seeking press conference, after disappearing for much of this month. Prosecutors declined to charge Winston with the alleged rape of Kinsman, as the evidence is so shoddy and so is her story, which is full of holes and inconsistencies. After Caroll's press conference, the governor and state attorney's office in Florida released statements revealing they are declining to investigate the Tallahassee Police and the case is closed.

Caroll stated during the press conference, the Tallahassee Police did not include an item in the case, indicating Kinsman had a lumbar strain, listed in the medical report, after she went to the hospital. The fact of the matter is the public does not know how Kinsman developed the lumbar strain. It can happen in a number of ways. It is not a definitive indicator of rape or sexual assault.

Caroll is stating authorities have questions to answer in this case. However, she and her niece are the ones who needs to answer some questions. Caroll needs to answer queries such as why photos of Jameis Winston and his side chick, her niece, Kinsman, wearing FSU gear, were deleted from her Facebook page according to students at the university. People connected to the team stated he and Kinsman secretly hooked up, but she became angry and offended when he wouldn't dump his out-of-state girlfriend for her (Breion Allen).

Caroll and Kinsman need to answer why social networking and several blogs are stating photos and hashtags that were on Twitter revealed, Kinsman was apart of the proudly self-proclaimed "Cleat Chasers" who got their stripes by having sex with Florida State football players (such as Winston).

Caroll and Kinsman need to answer why she and her niece did not follow up with the Tallahassee Police, having changed their minds about claims they'd made regarding Winston (also known as recanting). This failure to follow up brought the case to a screeching halt.

Caroll and her niece also need to answer why they wasted taxpayer money playing games, when a second man's DNA was discovered on her shorts, with Kinsman refusing to give his name. It cost the Florida taxpayers money when the government had to stop to investigate the men in Kinsman's life to ascertain the identity of the unnamed man/DNA, who turned out to be her boyfriend all the way in Ohio.

Kinsman could have easily given his name, saving the taxpayers money, but refused. She didn't want her boyfriend to find out she had cheated on him and with a football player. Rumors in Tallahassee allege, when her boyfriend finally found out about Winston, he attacked her. Is this where the lumbar strain came from.

For Caroll and Kinsman to be slamming the Tallahassee Police, when they failed to do their part in two notable incidents that greatly impeded the investigation at taxpayers' expense, lends a certain impression of hypocrisy regarding their criticism. The fact of the matter is there was a great lack of cooperation on Caroll and Kinsman's part, which would give any police force pause, like their time is being wasted.

It's quite telling that Caroll has resurfaced on the eve of the Heisman trophy being awarded, as it gives the impression she is trying mar the ceremony if Winston wins. Why now and not two weeks ago when the district attorney announced in a press conference there would be no charges against Winston, due to lack of evidence in the case and holes in Kinsman's story.

A man declines to make you his main chick, so you ruin his life with a lie. Next time put your big girl panties on and keep it moving. Many women have found out they are the side chick and moved on like grown women. You've wasted taxpayer money, press resources, stressed out a whole school and worst of all, made it that much harder for real rape victims to be heard.
